10 Danger Signs That Your Attorney May Not Be Able
To Effectively Defend Your DUI / DWI Case

BEWARE if your lawyer....

1. Does not ask questions about your diet in general - as this suggests your lawyer doesn’t understand the effect diet can have on the breath test result.

2. Does not ask about your drinking pattern on the day in question - as this suggests your lawyer doesn’t understand how the body absorbs, distributes and eliminates alcohol.

3. Does not ask about your general health - as this suggests your lawyer doesn’t understand the effect health conditions can have on the breath test.

4. Does not ask about what medications you were on - as this suggests your lawyer doesn’t understand the effect some medications can have on the breath test.

5. Does not independently calculate your blood alcohol content (BAC) - as this suggests that your lawyer does not understand how the Intoxilyzer works and why the result may not be accurate.

6. Does not explain NHTSA’s Standardized Field Sobriety Tests and how precisely they are to be administered and evaluated - as this suggests your lawyer does not know what Field Sobriety Tests have been standardized by NHTSA and won’t be able to effectively cross examine the arresting officer about what was done incorrectly.

7. Does not show you the Operator’s Manual for the Intoxilyzer 5000 (if you submitted to the test and it printed a result) - as this suggests the lawyer does not have the Operator’s Manual and does not know the proper procedures for the operation of the machine.

Does not discuss with you how the Intoxilyzer 5000 works, the assumptions on which the blood test result is based and the reasons the result may not be accurate - as this suggests your lawyer does not know how the Intoxilyzer works, does not know the assumptions on which it is based and does not know why the machine results may not be accurate.

9. Does not discuss with you the possibility of using experts to testify on your behalf and how they might assist you - as this suggests your lawyer accepts the Intoxilyzer result as being accurate and does not know how to challenge the result it provided.

10. Does suggest that you plead guilty during your initial consultation - as this suggests the lawyer does not know how to effectively defend a DUI / DWI case.
